While the divorce is pending
A pending divorce introduces uncertainty that lenders generally need resolved or documented: existing property, joint obligations, support terms and how the settlement will treat them. Your attorney's perspective matters here as much as the lender's.
- Existing mortgage liability may still be counted
- Support terms may not yet be final or documented
- State-specific legal considerations may apply
After the divorce is final
Once the agreement is complete and obligations are documented, the picture is usually clearer. The work then shifts to documentation history, credit, reserves and choosing a payment that leaves room for the rest of life.
